On November 17, 2021, WEATHINGTON Partners Heather McGrotty and Paul Weathington obtained a defense verdict in Cobb County after a trial that spanned seven days.
The case involved the tragic death of a 17-year old girl who was seen in the Spalding ER in 2016 and passed away the next day. She presented to the ER with flu-like symptoms but no respiratory complaints. On autopsy, she was found to have a rare and incurable condition known as Idiopathic Pulmonary Arterial Hypertension (f/k/a Primary Pulmonary Hypertension) with an incidental finding of pneumonia. The Plaintiff alleged that the pneumonia was misdiagnosed in the ER leading to her sudden death.
Heather assumed the primary lead role in the case, giving the opening statement, examining the majority of witnesses and sharing the closing argument with Paul. Defense experts included local renowned physicians, Kent Cohen, M.D. (Northside Gwinnett – ER) and Chad Miller, M.D. (Piedmont – Pulmonology).
