On August 26, 2021, WEATHINGTON attorneys Paul Weathington and Heather McGrotty obtained a defense verdict for their sports medicine orthopedic surgeon in DeKalb County State Court before the Honorable Judge Dax Lopez.
The care occurred over seven years ago and involved a post-operative infection, a known risk of any operative procedure, following Achilles tendon repair surgery. The plaintiff claimed the sutures were removed too early, despite the fact the surgeon found the incision to be clean, dry, and intact with no drainage at the time of suture removal. The plaintiff ultimately required multiple irrigation and debridement procedures and a tendon transfer. The plaintiff claimed chronic pain as a result and asked the jury for $13 million dollars in general damages.
Following only 1 ½ hours of deliberation, the jury returned a defense verdict.
